The European Union’s Artificial Intelligence Act (EU AI Act), enacted in 2024, is the world’s first comprehensive regulatory framework governing AI systems. While its primary enforcement applies within the EU, its influence extends beyond European borders. U.S. businesses operating internationally, particularly those providing AI-driven services or products to European clients, must pay close attention. As of February 2025, the Act’s bans on “unacceptable risk” AI practices are already in force, with financial penalties and compliance enforcement set to begin in August. This regulation is more than a legal hurdle for business leaders — it is a defining shift in AI governance that will impact market strategies, innovation, and ethical compliance for years.

Understanding the EU AI Act’s Prohibited AI Practices

The EU AI Act categorizes AI systems into four risk levels, ranging from minimal to unacceptable risk, with the latter facing outright bans. The strictest restrictions fall under Article 5, which prohibits AI practices that threaten fundamental rights, democratic values, or public safety. These prohibitions apply to companies based in the EU and to any organization whose AI systems impact EU citizens, regardless of location.

Among the most notable restrictions is the ban on AI systems that manipulate human behavior through subliminal techniques. For example, AI-powered toys that encourage risky behavior or lending algorithms that disproportionately target those with low financial literacy are explicitly restricted under the Act.

Another primary focus of the EU AI Act is social scoring, a practice similar to China’s social credit system, where AI ranks individuals based on their behaviors, personality traits, or predicted trustworthiness. The law prohibits AI-driven evaluations resulting in unjustified negative consequences, such as restricting access to services, opportunities, or rights. Similarly, predictive policing — AI systems that attempt to assess criminal behavior based on personality profiling — is banned due to ethical concerns over bias, discrimination, and potential infringements on due process.

Facial recognition technologies also face tight restrictions. The Act prohibits the mass scraping of images from public sources, including online platforms and CCTV footage, to build biometric databases. Additionally, real-time biometric surveillance in public spaces by law enforcement is primarily banned, with narrowly defined exceptions for counterterrorism or severe criminal investigations under judicial oversight. AI-driven emotion recognition is also restricted, particularly in workplaces and educational settings, preventing its use for assessing job candidates, employees, or students. Finally, biometric categorization — where AI systems attempt to infer sensitive characteristics such as race, religion, or sexual orientation from facial or body data — is explicitly prohibited to prevent discriminatory profiling.

Why U.S. Businesses Must Prioritize Compliance

The EU AI Act’s reach extends far beyond European borders, applying to any AI system that interacts with EU residents, whether directly or indirectly. Even U.S.-based companies without a physical presence in the EU can be subject to enforcement if European customers or partners use their AI tools. Non-compliance carries steep penalties, with fines reaching up to €35 million or 7% of a company’s global annual revenue, making it one of the most financially significant AI regulations to date. For example, a U.S. software company offering AI-driven HR solutions in Europe must ensure its technology does not engage in prohibited practices like emotion recognition during job interviews.

Beyond legal obligations, the EU AI Act will likely drive regulatory spillover, setting a global precedent that influences AI governance in other regions. Historically, EU regulations such as GDPR have catalyzed similar laws worldwide, including in the U.S., where states like California, Illinois, and New York are already implementing AI-related policies. Adhering to the EU AI Act now positions companies ahead of the curve as similar frameworks begin taking shape domestically. Firms that proactively align with the Act’s ethical AI principles will avoid regulatory roadblocks and gain a competitive advantage in securing contracts and partnerships in the global market.

Strategic Considerations for Business Leaders

For organizations integrating AI into their operations, compliance with the EU AI Act requires a strategic and proactive approach. Conducting a comprehensive audit of AI systems is the first step, mapping all existing and planned AI applications against the Act’s risk classification framework. Business leaders must assess whether their AI models involve prohibited practices, particularly in biometric data processing, emotion recognition, and AI-driven behavioral nudging. Companies offering AI services in the EU should also establish clear governance protocols, ensuring technical documentation, data transparency, and human oversight mechanisms align with regulatory expectations.

Ethical AI literacy and employee training should also become a priority. The EU AI Act mandates that organizations working with high-risk AI models provide education on AI governance, bias mitigation, and regulatory compliance. Companies can reduce legal risks by fostering internal expertise while promoting responsible AI deployment. Additionally, engaging with policymakers and industry consortiums can help businesses stay ahead of emerging AI regulations in the EU and evolving U.S. frameworks. As AI legislation continues to develop, proactive dialogue with regulators can ensure that industry leaders have a voice in shaping balanced policies that support innovation without compromising ethical standards.
